TERMS AND CONDITIONS INCLUSIVE ACFR & VRR

1 April 2005– 31 March 2006
The present document is for information only for car hires during period 1 April 2005– 31 March 2006. It has no legal value and has been created to reflect at best the current Hertz Australia terms and conditions for car hire in Australia during the aforementioned period. These terms and conditions may be amended without notice. The only binding contract between the hirer and the car hire company will be the contract signed by the hirer at time of vehicle pick-up and that the applicable terms and conditions will be the terms and conditions included in that contract.

Third Party Injury Liability and Goods & Services Tax (GST) @ 10%

Driving regulations

  • Minimum rental age: 21 years for car groups A, B, H, C, D, E, U, V, R
                                  25 years for car groups F, T, P, K, M
                                  30 years for car group G

  • Young driver surcharge: Drivers from 21 to 24 years will be required to pay a surcharge of A$ 16.50 ( Inc GST) per day,
    maximum fee: A$115.50 ( Inc GST) per rental

    Maximum rental age: There is no set minimum driving age, however, a medical certificate is recommended from drivers over 75. Ultimately it is the locations decision
    if they will rent to a driver over the age of 75.


    Please note all fees are subject to change.
    Renters must present a full, valid overseas driver’s licence which has been held for at least one year. Drivers must present either:
    1) A foreign drivers licence in English;
    2) A foreign driver’s licence in a language other than English accompanied by a certified English translation of the licence or a current International Drivers Permit.
    Both the international Drivers Permit and the driver's national drivers licence must be presented at the time of the rental.

Additional Authorised driver: free of charge, Minimum rental age and other requirements (including young driver surcharge) will be the same as for the renter. Additional authorised drivers must be registered on an Additional Drivers Application which forms part of the Rental Agreement.

Deposits
All rentals are subject to a deposit to cover additional costs such as Optional Renter Protection Services and fuel. Hertz accepts all major credit cards. Third party credit cards are not accepted.
The credit card presented must be in the name of the authorised renter. If the authorised renter does not hold a card acceptable to Hertz, please refer to the Cash Deposit clause.

Cash deposits
Authorised renters presenting an Inclusive Tour Voucher (ITV) and no credit card will be required to leave a minimum deposit of A$200 cash (A$ Travellers Cheques acceptable). Cash deposits are only acceptable on car groups A,B,H,C,D and E.

Cash deposits are not accepted at the Broome and Kununurra locations.

Rental Period
One rental day consists of 24 consecutive hours.

Minimum rental period for all car groups from Metropolitan locations is 24 hours.
Minimum rental period on all 4WD vehicles and Remote Cars is 3 days.

Extension of rental:
Should a customer whish to extend the prepaid rental period reserved, additional days will be charged, direct to the customer, at the local Hertz 'Extra Days' rate.

Late return:
When returning the vehicle Hertz allows a grace period of 59 minutes after which the clients will be liable for late return charges.
Late return charges are as follows:
1 hour late: One half of the 'Extra Days' rate will apply.
2 hours late: One full day of the 'Extra Days' rate will apply.

Upgrade:
Voluntary upgrades as purchased at time of rental will be charged, direct to the customer, at the locally applicable upgrade rate. All upgrades are subject to availability.

Extension of rental
If client, at the commencement of his or her rental, requests to rent for a period longer than the number of days reserved, that extension may be granted if the person qualifies for it.
Additional days will be charged direct to the renter at the local Hertz “Extra Days” rate applicable at time of rental.
Please note that one rental day equals 24 hours commencing on each day at the same time as the rental began, as shown on the Rental Agreement.
Extra hours/days are charged at locally applicable rates. Any additional options (i.e: AER, PAI, PEC etc) purchased at the commencement of rental are due in full for each full or partial rental day.


Driving restrictions
Collision Damage Waiver (CDW) is invalid under the following circumstances:



Accident Damages

Hertz Tour Rates in Australia include Collision Damage Waiver (CDW) which provides cover for accident damages to the Hertz vehicle and/or Third Party Property. CDW is deemed invalid if the renter does not comply with the rental terms and conditions. In the event of accident damage, an Accident Damages Excess (ADE) will apply. This is the amount the renter contributes to the loss of, or damage to, the Hertz vehicle.

For all 4WD and car rentals originating from Remote and 4WD locations, a Single Vehicle Accident (SVA), excess also applies. The excess applies to any accident in which the vehicle is involved, which does not involve the vehicle colliding with another moving vehicle, including but not limited to rollovers, collisions with animals, immersion in water and reversing into stationary objects.


‘Single Vehicle Accident’ damage means any accident, in which the vehicle is involved, which does not involve the vehicle colliding with another moving vehicle, including but not limited to rollovers, collisions with animals, and reversing into stationary objects.

  • Premium Protection Package (PPKG): Applicable to 4WD vehicles. PPKG combines AER with the benefits of Windscreen buyout. This option also reduces the SVA
  • Premium Accident Excess Reduction (PAER): Applicable to 4WD vehicles, this option reduces the AER and the SVA.
  • “SNO” Option poriveds CDW for vehicles being driven above the snow line (e.g, Alpine Resorts). It is available for car groups D E at a cost of A$22 per day (inc GST). The 'SNO' Option is available with 72 hours notice and may be purchased from all Corporate locations and selected Licensee locations. Please note, Group E vehicles are fitted with cargo barriers that cannot be removed. Long objects, such as skis, cannot be accommodated.

Third Party Property and injury insurance cover
Third Party Property Liability Insurance is automatically covered under a third party property damage Master Policy executed by Hertz and is subject to the renter complying with all Terms and Conditions of the rental and payment of the Accident Damages Excess. Third Party Liability cover for personal injury is governed by separate Government legislation in each Australian State and Territory. The right to claim may be limited by the legislation and excesses may apply.


There are many factors relevant to a determination of which third party liability cover for personal injury will apply in the event of an accident, such as the state or territory in which a vehicle is registered, the state or territory in which the accident occurs and the state or territory in which another driver or injured person resides. Should an accident in which a person is injured occur, the renter should contact the police, Hertz and the insurer of the state or territory in which the hired vehicle is registered.


This summary of the cover available throughout Australia is meant as a guide only and no warranty of accuracy or reliability is given or responsibility accepted by Hertz for the information contained below. In the event of an accident, the renter should make independent enquiries of the relevant insurer of the vehicle.

Queensland: Injured person or the dependents of a deceased person can bring claim for damages against a negligent party.


New South Wales: Compensation is available for persons injured or killed by the negligence of a motor vehicle driver. At fault drivers are not covered.


Western Australia: Damages may be claimed by persons injured or by the relatives of a person killed by the negligence of a motor vehicle driver.

South Australia: Damages may be claimed by persons injured or by the relatives of a person killed by the negligence of a motor vehicle driver.

Victoria: Combination of no fault and negligence indemnity. Statutory benefits in the nature of weekly payments during incapacity for work, impairment benefit annuities, medical and like expenses and death benefits may be available regardless of the question of fault. In addition, damages may be claimed by persons seriously injured or killed by the negligence of a motor vehicle driver.


Tasmania: Combination of no fault and negligence indemnity. No fault medical benefits, death benefits, disability benefits and disability allowances may be claimable. Injured persons or dependents of deceased persons can also bring claims for damages against negligent parties.


Northern Territory: Claims for damages may be brought by persons injured by the negligence of a motor vehicle driver or by the dependents of a deceased person. Entitlement to no fault statutory benefits restricted to residents of Northern Territory. Non residents may apply to the Board of the Territory Insurance Office to be treated as a resident.


Australian Capital Territory: Injured persons or the dependents of deceased persons can bring claim for damages against a negligent party.

As specific compensation figures vary so widely depending on the circumstances of individual claims they cannot be quoted.

The freesale and request conditions below apply only at locations where vehicles are shown as available in the above table.

Reservations
To ensure the most efficient service to your clients, it is MANDATORY to provide Hertz with the correct pick-up and drop-off times and flight details (if applicable). Please ensure this information is confirmed with Hertz prior to your clients departure. Wholesaler Booking Reference Numbers must be advised at time of reservation.


Vouchers
Hertz Australia Vouchers or Hertz Approved Tour Operator Vouchers, including Booking Reference Number (if applicable) and Hertz IT Number must be issued for all vehicles.
One voucher is now applicable for each rental irrespective of length.
Gift Certificates and other promotional vouchers are not acceptable as payment for additional services.
Frequent Flyer points are not offered against the value of Inclusive Tour programs.

Refunds
No refunds will be issued on any unused portion of the inclusive tour voucher.

No shows
Where a client does not pick up his rental vehicle at the date and time confirmed on the reservation, Hertz reserves the right to charge a No Show fee equal to the cost for one rental day as per the reservation. For Group M vehicles a $110 no show fee will apply.

Optionals
Camping equipment . The standard Camping package is available in conjunction with the Group R vehicle for a minimum of 7 days. It is available from the                                    following locations only: Darwin, Alice Springs, Ayers Rock, Broome and Kununurra. For further details please contact our agent.
Child seat: available on request, at A$ 19.80 for 1 to 3 day rentals. Cost capped at A$ 66.00 per rental. Rates include GST
Luggage rack: not available
Mobile/ in car phones: not available

Invoicing
Rentals will be invoiced at the agreed wholesale rate applicable on the day of vehicle
collection. If a vehicle is collected on 25 March 2005 and is returned 5 April 2005, the entire retnal will be invoiced at the rate applicable as at 25 March 2005.

Disclosure
Hertz Australia agrees to provide 30 days written notice, or other such notice, of any changes as set out in these Terms and Conditions.

Location Service Charge (LSC) may apply as a fixed fee per rental and notification of the implementation of this charge will be given with a minimum of 30 days notice.

Hertz reserves the right to increase net rates due to any changes to the current rate of GST.

Infringement Administration Fee
An infringement Administration Fee may be applied to rentals where the renter has incurred a fine and where Hertz is required to process that fine. The Infringement Administration Fee is A$33.00 including GST.

Standard Terms and Conditions
All rentals will be subject to Hertz standard Rental Terms and Conditions. Renters must execute and accept these terms and conditions (in the form prevailing at the time of rental) when they collect vehicles.
In the event that any of the information published in these Wholesale Tours Terms and Conditions is inconsistent with Hertz Standard Rental Terms and Conditions (as varied from time to time) the latter prevail. It is the Tour Operator’s obligation to ensure that any information you provide to renters corresponds with Hertz then prevailing Rental Terms and Conditions.
